1. Scope and definitions

These “Terms of Use” govern access to and use of all websites, tests, toolkits, online systems, and platforms owned and operated by HYPERMOBILITY HEALTH Pty Ltd (ABN 18 679 956 480) trading as HYPERMOBILITY HEALTH CONNECT® (“HHC”).

Together, these websites, tests, toolkits, online systems and platforms are referred to collectively as the Online Services, and include (without limitation):

• hypermobilityhealth.com.au, providing general health information and resources;
• hypermobility.smartersoft.io, providing the HHC Self-Screening Test for Hypermobility (SSTH), related digital tools, and practice management software;
• professional health services for patients (e.g. telehealth services);
• training, education, and related services for health professionals.

By accessing or using any of the Online Services, you agree to be bound by these Terms of Use and the HHC Privacy Policy. If you are a Practice, you also agree to be bound by the HHC Practice Service Agreement.

Definitions

“SSTH” means HHC’s Self-Screening Test for Hypermobility and all associated tools, reports, outputs, and materials made available by HHC.

“Online Services” collectively refers to all websites, tests, toolkits, online systems, platforms, and other digital services owned, controlled, or operated by HHC, including but not limited to HHC’s SSTH and all associated content, data collection, and reporting functionalities.

“Information” means all content, materials, communications, and resources provided or made available by HHC through the Online Services, including (without limitation):

• content, materials, and resources published on HHC websites, tests, or toolkits;
• any correspondence or communications provided by HHC through email, SMS, telephone, or other print or digital messaging services;
• online and offline publications such as e-books, guides, white papers, test results, fact sheets, articles, news updates, alerts, events, or research findings;
• outputs, reports, and results generated by digital tools, the SSTH, or practice management software; and
• training materials, course content, CPD modules, and other educational resources provided to health professionals and practices;
• information accessed via links to third-party websites or service providers.

“Organisation” means any entity, whether incorporated or unincorporated, that uses the Online Services in a business, professional, commercial, or not-for-profit capacity, including (without limitation) companies, partnerships, trusts, associations, government bodies, educational institutions, sole traders, and independent contractors. Where an Organisation is also a Practice, the definition of Practice applies to the extent of that use.

“Practice” means a registered health practice or individual health professional that uses the SSTH within their practice, accesses HHC practice management software, or receives training, education, or clinical practice services from HHC. A Practice is a subset of Organisation and is additionally bound by the HHC Practice Service Agreement in connection with those activities.

“Individual” means a person using the Online Services in their private, personal capacity (for example, a consumer, patient, or member of the public).

“You” or “Your” means any person or entity that accesses or uses the Online Services, including both Individuals (personal use) and Organisations (professional or institutional use), as applicable.

“Practice Service Agreement” or “PSA” means the HHC Practice Service Agreement.

“Terms of Use” collectively refers to these terms and conditions, the HHC Privacy Policy, and any other notices, disclaimers, conditions, or statements appearing on or in connection with the Online Services.

General Provisions

Your use of and access to the Online Services and Information are subject to these Terms of Use. By accessing, viewing, or using any part of the Online Services or Information, you agree to comply with and be bound by these Terms of Use. If you do not agree, you are not authorised to use the Online Services.

If you use any part of the Online Services that is subject to additional or alternative terms and conditions, you must also comply with those additional terms.

2. Important information

HHC provides general health-related Information and Online Services for informational purposes only. These Online Services are not intended to replace professional medical advice, diagnosis, or treatment, nor are they designed to address emergency or acute medical conditions. If you are experiencing a medical emergency or an acute illness, please seek immediate assistance from a qualified medical professional or contact emergency services on Triple Zero (000) and ask for an ambulance.

You are solely responsible for assessing the applicability, accuracy, and suitability of the Information provided to your individual circumstances. Reliance on this Information, whether by taking action or failing to take action, without obtaining independent, professional medical advice, is expressly disclaimed. 

While the Online Services and Information aim to assist you in identifying potential health-related concerns and guide you toward seeking further information or professional advice, they are not tailored to your specific circumstances. You must not disregard or delay seeking professional medical advice because of any Information obtained from the Online Services. This includes follow-up actions or recommendations derived from your use of the Online Services. HHC expressly advises you to consult with a qualified healthcare professional, such as your GP or a specialist, for personalised medical advice, diagnosis, or treatment. The Online Services are intended for individuals located in Australia and may not be suitable or applicable for use in other jurisdictions.

3. Privacy Policy

HHC has adopted a Privacy Policy that you should refer to in order to fully understand how we collect and use your information. The HHC Privacy Policy can be accessed here.

4. Acceptance and changes to Terms of Use

HHC may, at our sole discretion, vary or modify these Terms of Use without notice to you. Any subsequent access to or use of the Online Services by you will constitute acceptance of those modifications.

The current version of the Terms of Use will be posted on this website and will supersede any previous versions. This constitutes sufficient notice by HHC of any variation or replacement, to the extent required by law.

You agree that, where HHC is required, by law or otherwise, to provide you with any notice or document, you consent to the provision of that notice or document electronically through the Online Services, including via any User Account.

For changes to the Online Services refer to section 18.

5. Restrictions on your use of the Online Services

You agree not to use the Online Services to post, e-mail, upload, or otherwise transmit any:

1. information or material of any kind that:
   • is unlawful, discriminatory, harmful, abusive, threatening, harassing, defamatory, offensive, or infringes the rights of any person (including but not limited to privacy rights and intellectual property rights); or
   • contains software viruses or any other malware designed to damage, destroy, interrupt, or limit the function of any computer software, hardware, or systems.
2. unsolicited or unauthorised advertising, promotional materials, “junk mail”, “spam”, or any other form of solicitation.

As a condition of your use of the Online Services, you acknowledge and agree that you will not:

1. use, sublicense, retrieve, publish, display, modify, copy, sell, distribute, transmit, download, or create extracts from, or plagiarise works from, our websites (except where necessary to access or view the Online Services content on your browser or as otherwise permitted by applicable copyright legislation), without HHC’s prior specific written permission;
2. impersonate any person or entity (including, but not limited to, an authorised HHC employee or agent);
3. interfere with, damage, disable, or otherwise disrupt the Online Services, or the infrastructure used by the Online Services;
4. use the Online Services for any purpose that is unlawful or prohibited by these Terms of Use;
5. intimidate, harass, or “stalk” any user of the Online Services;
6. obtain or attempt to obtain any content through any means not intentionally made available or provided through the Online Services;
7. use any robot, spider, other automatic device, or manual process to monitor or copy web pages from the Online Services;
8. attempt to circumvent, disable, or otherwise interfere with any security-related features of the Online Services, including features designed to prevent unauthorised access, data extraction, or reverse engineering;
9. engage in any activity that compromises the integrity, performance, or functionality of the Online Services, including overloading systems or transmitting malicious software.

If you create a link to the Online Services, you remain fully responsible for any consequences of that link, whether direct or indirect, and you will protect HHC against all loss, damage, liability, cost, or expense arising from or in connection with the link.

If you are a Practice, additional restrictions on use apply under the HHC Practice Service Agreement.

6. Your responsibilities, accounts, and security

By accessing or using the Online Services, you accept the responsibilities below. Additionally, to access some Online Services, a personalised account that allows you to login securely, save information, engage with features, and receive tailored communications may be provisioned for you by HHC (“User Account”).

General responsibilities (including Individual members of the public):

1. You must provide accurate, complete, and current information when using the Online Services, including completing SSTH or other services.
2. You will use the Online Services and Information only for their intended purposes, which include providing general health information and tools to guide you in seeking further professional advice or assistance.
3. You are responsible for ensuring that any device used to access the Online Services is secure, properly maintained, and free from viruses, malware, or other harmful components.
4. Where you provide HHC with information related to a child or other individual, you warrant that:
   1. you are the legal guardian of the child or have the legal authority to provide their information to HHC;
   2. any information provided about another individual is accurate and does not infringe their rights, including their privacy, consent, reputation, or any legal entitlements.

Third-Party Service Provider responsibilities (includes Practices, Organisations and paying members):

1. If you are a Practice or health professional accessing the Online Services in a professional or organisational capacity, your use is governed by the HHC Practice Service Agreement. By accessing the Online Services as a Practice, you agree to be bound by that agreement in addition to these Terms of Use.

User Account responsibilities:

1. If HHC permits you to create a User Account to access the Online Services, the account is for your personal or authorised use only and is non-transferable.
2. To create a User Account, you must provide an email address and password. Optional details, such as phone numbers, may be provided to support account setup and authentication.
3. You must be aged 16 years or older to create a User Account.
4. You must maintain updated contact information to ensure effective communication with HHC and avoid interruptions to your services.
5. You must protect your User Account credentials (e.g., username and password) and ensure they are kept confidential.
6. In the event of any unauthorised access, breach of security, or misuse of your User Account, you must notify HHC immediately.
7. You are responsible for all actions and activities conducted under your User Account, regardless of whether such actions were authorised by you.
8. You must act responsibly and avoid misuse of any content, tools, or services offered through the Online Services.

HHC reserves the right to suspend or terminate your User Account if it determines that the account has been misused, or if any information provided during registration is incomplete, false, or inaccurate. In cases of non-compliance with these Terms of Use, HHC may take further action, including suspension, termination, or initiating legal proceedings, as deemed appropriate.

7. Disclaimer of warranties and representations

The Online Services and Information are provided strictly “as is” and “as available”, without any guarantees or warranties of any kind. Your use of the Online Services and Information is entirely at your own risk.

To the fullest extent permitted by law, HHC makes no representation or warranty (express or implied) regarding the currency, completeness, accuracy, reliability, suitability, security, fitness for purpose, non-infringement of third-party rights, or availability of the Online Services or Information provided, or that the Online Services or Information will meet your requirements. Specifically, HHC does not guarantee that:

1. the Online Services and Information are free from errors, inaccuracies, or omissions;
2. the Online Services will operate without interruption or delay;
3. the Online Services will be secure, free from viruses, malware, or other harmful components;
4. the Online Services or Information will meet your specific Individual or Organisational expectations or requirements.

HHC’s Online Services and Information may include links to websites operated by third parties (“Third-Party Websites“) or feature information about third-party service provider Organisations (“Third-Party Service Providers“), services, or facilities. These are provided for your convenience only and do not imply endorsement, recommendation, or verification by HHC.

Third-Party Websites

HHC does not control or guarantee the accuracy, completeness, security, or reliability of information available on Third-Party Websites. HHC assumes no responsibility or liability for your use of, or reliance on, such websites or the content they provide.

Third-Party Service Providers

HHC does not endorse, recommend, or warrant the quality, suitability, or appropriateness of any Third-Party Service Providers, services, or facilities featured in the Online Services or Information. Interactions with third-party healthcare providers are undertaken at your own risk, and it is your sole responsibility to verify their credentials, qualifications, and suitability for your needs.

Practice warranties

If you are a Practice, additional warranty exclusions specific to your use of HHC services apply under the HHC Practice Service Agreement.

8. Disclaimer and limitation of liability

To the maximum extent permitted by law, HHC expressly disclaims all liability (including for negligence) for any direct, indirect, or consequential loss, damage, injury, expense, or cost incurred by you (whether as an Individual, Organisation, or otherwise) arising from your use of, inability to use, or reliance upon the Online Services or Information, including but not limited to circumstances where:

1. you are unable to access, update, or delete your User Account, or experience any delay in doing so;
2. there is a delay, interruption, or inability to use the Online Services;
3. the Information or tests provided through the Online Services are incorrect, incomplete, inappropriate, or unsuitable for your purposes;
4. the Online Services or Information are used for purposes other than those intended or contain errors, omissions, or inaccuracies;
5. you are unable to obtain consistent, reliable, or uninterrupted access to the Online Services or Information;
6. damage or interference occurs to your computer, mobile device, system, associated equipment, software, or data in connection with your use of the Online Services;
7. you rely on an interpretation or opinion derived from, or which may be inferred from, the Online Services or Information;
8. you rely on the Online Services or Information as a diagnostic instrument or substitute for independent clinical judgement;
9. you use the Online Services or Information in connection with your professional or commercial activities, including clinical decision-making, training, advertising, or promotional use;
10. there is a delay or failure to receive Information or communications you have subscribed to;
11. inaccurate or unreliable information is obtained from websites accessed via links from the Online Services;
12. you rely on, or are affected by, Third-Party Websites or Third-Party Service Providers, including their content, services, advice, suggestions, or recommendations, whether made directly to you or accessed via the Online Services.

HHC will not be responsible or liable for any clinical, professional, or commercial decision, outcome, or representation made by you, whether as an Individual or on behalf of an Organisation, in connection with your use of the Online Services, Information, or any related materials.

To the extent permitted by law, if HHC is found liable for failing to comply with any consumer guarantees under Part 3-2 of the Australian Consumer Law, HHC’s liability is limited, at our sole discretion, to:

1. supplying the services again; or
2. paying the cost of having the services supplied again.

If you are a Practice, additional and more extensive limitations of liability apply under the HHC Practice Service Agreement.

9. Indemnity

You agree to indemnify, defend, and hold harmless HHC, its directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

1. your breach of these Terms of Use or any applicable laws and regulations;
2. your misuse of the Online Services or Information, including but not limited to:
   1. engaging in prohibited activities outlined in section 5;
   2. submitting inaccurate, incomplete, or misleading information;
   3. using the Online Services for purposes other than those expressly permitted;
3. any claim made by a third party arising from your use of the Online Services, Information, or any content you provide or actions you take on the platform;
4. any unauthorised access to your User Account or misuse by a third party if such access resulted from your failure to maintain the security of your login credentials;
5. any action or inaction taken by you, or by any other party acting under your direction, based on your use of or reliance on the Online Services or Information.

This indemnity survives the termination of your access to the Online Services and remains enforceable even after you cease using the Online Services.

If you are a Practice, additional and more extensive indemnity obligations apply under the HHC Practice Service Agreement.

10. Vulnerable populations

You may find that interacting with the Online Services has the potential to cause discomfort or distress.

Sensitive nature of content

HHC recognises that certain Individuals may be particularly vulnerable when engaging with the Online Services, including but not limited to:

1. Persons experiencing chronic pain, disability, or complex medical conditions;
2. Persons with mental health conditions or psychological distress;
3. Persons from culturally and linguistically diverse backgrounds who may have difficulty interpreting health information;
4. Children, adolescents, and their guardians who are seeking medical guidance;
5. Older adults and individuals with cognitive impairments who may require assistance in understanding and applying health-related information.

The Online Services provide general health-related information and resources, which may include content that is sensitive in nature. Users who may be affected by such content are encouraged to seek guidance from a qualified healthcare professional before acting upon any information obtained through our platform.

No substitute for personalised medical advice

While the Online Services aim to promote awareness and support informed decision-making, they are not intended as a substitute for professional medical, psychological, or crisis intervention services. Users who require personalised advice, treatment plans, or urgent assistance should consult an appropriate healthcare provider.

If you or someone you know is experiencing distress or a medical emergency, please seek immediate assistance from a qualified professional or contact emergency services on Triple Zero (000) and ask for an ambulance.

Access and use by minors

Minors (persons under 16 years of age) should only access the Online Services under the supervision of a parent, guardian, or caregiver. Any individual providing information on behalf of a minor must ensure that they have the legal authority to do so and that such information is accurate and complete.

Mental health considerations

Some individuals may experience distress when engaging with self-assessments, screening tools, or reading content about chronic health conditions. If you feel overwhelmed, anxious, or distressed while using the Online Services, we recommend that you:

1. Pause your engagement with the content and take time to process the information at your own pace;
2. Speak with a trusted family member, friend, or support network;
3. Seek professional guidance from a GP, psychologist, counsellor, or other qualified health professional.

Accuracy and appropriateness of information

HHC endeavours to provide information that is evidence-based, accurate, and aligned with reputable medical sources. However, given the diversity of medical conditions, personal health experiences, and cultural contexts, the applicability of our Information may vary between users. If you believe that any content may be inappropriate, misleading, or require clarification, please contact HHC to request a review.

Third-party support

HHC does not provide emergency medical services, crisis intervention, or direct medical care. Users are responsible for seeking appropriate care through licensed healthcare professionals, emergency responders, or relevant community support services as required. Where the Online Services provide links to external resources, helplines, or third-party service providers, these are offered as general references only. HHC does not warrant or endorse the quality, suitability, or effectiveness of any third-party service, and users must exercise their own discretion before engaging with external providers.

11. Self-Screening Test for Hypermobility (SSTH) disclaimer

The SSTH is provided strictly for general informational purposes and is not intended to serve as medical advice, diagnosis, or treatment. Test results are generated solely based on the information you provide and do not account for your complete medical history, individual circumstances, or other factors that may affect your health. You acknowledge and agree that SSTH is not diagnostic tool and are not a substitute for consultation with a qualified healthcare professional. You further agree that:

1. You are solely responsible for any decisions, actions, or inaction arising from your use of the SSTH, including reliance on any result or failure to seek appropriate professional medical advice.
2. You will not delay, disregard, or substitute professional medical consultation or treatment based on any SSTH result or related Information.

All SSTH test results are provided “as is” without any warranty, representation, or guarantee, express or implied, including but not limited to warranties of accuracy, completeness, reliability, timeliness, suitability for a particular purpose, or fitness for use.

To the fullest extent permitted by law, HHC expressly disclaims all liability for any loss, damage, injury, or harm resulting from:

1. Reliance on any SSTH result or related Information.
2. Failure to seek professional medical advice, diagnosis, or treatment based on any SSTH result.
3. Errors, inaccuracies, omissions, or any other issues associated with SSTH or results.

By using the SSTH, you accept full responsibility for your health-related decisions and agree to release HHC from any claims, liabilities, or damages arising from or related to your use of the SSTH or any Information provided.

12. Security, viruses, errors, and availability

The internet is an inherently insecure public network, which means there are risks that Information sent to or from the Online Services may be intercepted, corrupted, or modified by third parties. Additionally, files or content obtained from or through the Online Services may contain computer viruses, disabling codes, worms, malware, or other harmful components. You assume all risks and responsibility for any loss or damage caused, directly or indirectly, by these risks.

13. HHC affiliated products and services

Affiliated products

The Online Services may feature or link to products sold by third-party affiliates (“Affiliated Products“), including health-related goods, tools, devices, equipment, educational materials, or promotional offers. HHC does not control or guarantee the quality, suitability, safety, or effectiveness of any Affiliated Products. You are solely responsible for conducting your own due diligence before purchasing or using such products.

Training services

Training services offered to health practices and professionals are governed by the HHC Practice Service Agreement.

Indemnity for affiliated products and partner services

HHC assumes no liability for your purchase, use, or reliance on any Affiliated Products, or partner services. By engaging with these offerings, you agree to indemnify, defend, and hold harmless HHC, its directors, employees, agents, affiliates, and partners from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

1. misuse or misrepresentation of Affiliated Products;
2. issues related to the quality, performance, or safety of Affiliated Products;
3. transactions or engagements with third-party sellers or service providers.

14. Intellectual property

All content, materials, and Information available through the Online Services, including but not limited to text, graphics, logos, designs, and software, are owned or licensed by HHC and are protected under Australian copyright laws and international intellectual property treaties.

You may use the Information solely for personal, non-commercial purposes, provided you do not reproduce, distribute, display, modify, transmit, create derivative works from, or otherwise exploit the Information without HHC’s prior written permission.

The HHC logo and all trademarks appearing on the Online Services are the exclusive property of HHC or our affiliates and partners. These trademarks must not be used, copied, or reproduced in any form without explicit prior written consent from HHC. The structure, layout, and presentation of our websites, as well as any software used to operate them, constitute HHC’s intellectual property or that of our partners or affiliates. HHC grants you a non-exclusive, non-transferable, limited right to:

1. access and use the Online Services;
2. view the Information on your screen; and
3. print copies of the Information solely for your personal, non-commercial use;

provided you comply fully with these Terms of Use and refrain from any unauthorised activities, including reverse engineering, decompiling, or attempting to extract source code from the software or platforms.

Any unauthorised use of HHC’s intellectual property is strictly prohibited and may result in legal action.

15. Ownership and licence of submitted information

By submitting any information, data, content, or materials (“User Submissions”) through the Online Services, whether as an Individual, Organisation, or otherwise, you acknowledge and agree that:

Licence to us (HHC)

You grant HHC a worldwide, perpetual, irrevocable, royalty-free, transferable licence (with the right to sublicense) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate, commercialise, and otherwise exploit such User Submissions for the purposes of:

1. research and analysis;
2. product and service development and improvement; and
3. other legitimate business and commercial activities.

If our business (or part of it) is sold, merged or transferred, your information and the rights granted under this licence may be assigned or transferred to the acquirer.

No compensation

You understand and agree that you will not be entitled to any payment, royalties, or other compensation in connection with our use of User Submissions under this licence.

Personal information

Where User Submissions contain personal information (as defined under the Privacy Act 1988 (Cth)):

1. We will collect, store, use, and disclose such personal information in accordance with our HHC Privacy Policy;
2. You consent to us, and any successor or acquirer of our business, using and commercially exploiting your personal information, including your health information, in both identified and de-identified form, for the purposes set out in this clause 15;
3. The commercial-use rights in point 2 do not apply to the personal information of individuals under 18 years of age.

Assignment of rights

By submitting any materials (other than personal information) through the Online Services, you assign to us all intellectual property rights you hold in those materials. To the extent that assignment is not legally effective, you grant us the licence described above.

Authority

You warrant that you have the right, power, and authority to grant the rights and licences set out in this clause, whether you are acting in your own capacity as an Individual or on behalf of an Organisation.

Organisational access to User Submissions

HHC may provide Organisations with limited access to view User Submissions relating to their clients, patients, or end users for internal reference purposes only. This access is non-exclusive, non-transferable, revocable at any time, and subject to compliance with these Terms of Use and our HHC Privacy Policy.

16. Practices, Organisations and health professionals

If you meet the definition of a Practice under these Terms of Use, your use of the relevant Online Services is additionally governed by the HHC Practice Service Agreement. The Practice Service Agreement is a master framework agreement covering free access to the SSTH, all current Paid Services (including SSTH paid features, clinical software, professional training, and leads generation services), and any future services introduced by HHC.

17. Cancellation policy

Where we offer professional health services (e.g. telehealth services), to help us manage clinical availability and to ensure the fair offering of appointments to other patients, we kindly ask that at least 48 hours’ notice be provided if you need to cancel or reschedule an appointment. Notice must be given by email to info@hypermobilityhealth.com.au.

If less than 48 hours’ notice is given, a cancellation fee may be charged. In most instances, this will be 50% of the appointment fee, and may increase to up to 100% of the appointment fee for same-day cancellations, missed appointments, or non-attendance. Patients who arrive late may have their consultation time reduced, and where the appointment cannot reasonably proceed, the booking may be treated as a late cancellation or non-attendance. This policy applies to all consultations and appointment types.

We appreciate that unforeseen circumstances may occasionally arise, and any exceptional situations will be considered at our discretion on a case-by-case basis.

Where a prepaid appointment is cancelled with sufficient notice and a refund is applicable, a processing fee of $25 per appointment will be deducted from the refund amount to cover payment processing costs and administrative time. This fee applies regardless of the cancellation reason.

By confirming or attending any appointment, or by making a payment toward an appointment, you agree to this cancellation policy.

18. Modifications to the Online Services

HHC reserves the right to modify, suspend, or discontinue any aspect of the Online Services or Information at any time, without prior notice or liability to you. This includes, but is not limited to, changes to functionality, availability, or the content of the Online Services, and any websites, tests, or toolkits.

While HHC strives to provide consistent and uninterrupted access, HHC does not guarantee that the Online Services will always be available, error-free, or operate without interruption. HHC will not be liable for any loss, damage, or inconvenience caused by modifications, suspensions, or discontinuations of the Online Services or Information.

19. Termination

HHC may terminate your access to the Online Services at any time for any reason, including violation of these Terms of Use. All clauses in these Terms of Use which are stated or intended to continue after termination will continue to apply, however, you will no longer be authorised to access the Online Services.

20. Severance

If a provision of these Terms of Use is held to be void, invalid, illegal or unenforceable, that provision must be read down as narrowly as necessary to allow it to be valid and enforceable.
